These Terms and Conditions (“Terms”) govern your access to and use of https://www.printsmith3d.store/ (the “Site”) and any purchase of products or services from PrintSmith3D LLC (“PrintSmith3D,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.

 

If you do not agree, do not use the Site.

2) Eligibility

 

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By placing an order, you represent that you are legally able to enter into this agreement.

3) Changes to Terms

 

We may update these Terms at any time by posting an updated version on the Site. Changes become effective upon posting. Your continued use of the Site constitutes acceptance of the updated Terms.

4) Products and ServicesWe offer:

​

•Physical goods (including made-to-order and customized items)

•Custom services (including, as applicable, design, modeling, prototyping, finishing, and related production services)

 

Made-to-order and custom items: Images, renders, and mockups are representative.

 

Minor variations may occur due to materials, printing orientation, supports, layer lines, tolerances, finishing methods, color batch variance, and display/device differences.

5) Quotes, Orders, and AcceptanceOrder placement:

​

An order submission is an offer to purchase. We may accept or decline an order at our discretion (including due to capacity, errors, suspected fraud, or IP concerns).

​

Quotes (custom/non-listed work):

•Quotes are valid for 21 days unless stated otherwise.

•Custom quotes may include scope, revisions, timelines, deposits, and shipping terms.

•If you approve a quote, you authorize us to begin work consistent with the approved scope.

 

Errors: If a listing, quote, or invoice contains an error (including pricing, availability, or description), we may correct it and/or cancel the order and issue a refund.

6) Payments, Taxes, and FeesCurrency:

Prices are listed in USD unless stated otherwise.

 

Payment: We accept payment via electronic and cash. By providing payment information, you represent that you are authorized to use the payment method and authorize charges associated with your order.

 

Sales tax: We collect sales tax where required. Taxes are applied according to applicable law and the information you provide (e.g., shipping address).

 

Chargebacks: If you initiate a chargeback without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and provide documentation to the processor. We may suspend future orders in cases of suspected fraud or abuse.

7) Shipping and DeliveryGeneral policy:

 

Shipping is free unless otherwise stated.

 

Exceptions: Shipping may be charged for:

•Exclusive offers, and/or

•Direct design work or non-listed items / special orders

 

In these cases, shipping terms and any fees will be disclosed at checkout or provided in your written quote/invoice before fulfillment.

Processing/production time: Production times are estimates and not guarantees.

 

Delivery time: Carrier transit times are outside our control. We are not responsible for delays caused by carriers, weather, supply chain issues, or other events beyond our reasonable control.

 

Address accuracy: You are responsible for providing a complete and accurate shipping address. If an order is returned due to an incorrect address or failed delivery attempts, reshipment may require additional fees.

 

Risk of loss: To the extent permitted by law, risk of loss transfers to you when the carrier takes possession of the shipment.

8) Cancellations and Changes

 

Non-custom orders:

You may request cancellation before fulfillment/shipping. Once shipped, cancellation is not available.

​

Custom/made-to-order orders and services:

Because custom work typically begins promptly and may involve non-recoverable time/materials:

•You may request cancellation before production/design work begins.

•Once work begins, cancellations may not be possible and may incur charges for time/materials already committed.

•Approved proofs/specs that later change may require a revised quote and timeline.

9) Returns, Refunds, and Exchanges

 

All sales are final for custom work except as required by law or as specifically stated below.

 

Non-returnable / non-refundable:

•Custom or personalized items

•Made-to-order items produced to your specifications

•Services already performed (including design/modeling time, rush fees, and prototyping)•Items damaged due to misuse, improper installation, modification, or normal wear

 

Damaged/defective/incorrect items:

If your order arrives damaged, defective, or incorrect, contact us at printsmith3dllc@gmail.com within 14 days of delivery and include:

•Order number

•Photos of the packaging and item

•Description of the issue

 

We will evaluate and, at our option, repair, replace, or refund as appropriate.

Non-custom returns:

•Return request window: 14 days

•Condition requirements: unused, original packaging

•Return shipping: [customer-paid / PrintSmith3D-paid for our error]

10) Custom Services (Design/Modeling/Prototyping)

 

If you purchase custom services, the scope and deliverables will be defined by a written quote, invoice, or statement of work (“SOW”).

 

Client responsibilities:

•Provide timely responses, accurate specifications, and required reference materials

•Review and approve proofs, renders, dimensions, and functional requirements

•Confirm fitment/compatibility with your equipment or environment

 

Revisions: Unless otherwise stated, quotes include 3 revision rounds. Additional revisions may be billed.

 

Client-provided files/content: You represent that you own or have permission to use any files, logos, models, designs, or other materials you provide and that they do not infringe third-party rights.

11) Intellectual Property and Licensing

 

Our IP: The Site content, branding, photos, text, and our original designs and processes are owned by PrintSmith3D or its licensors and protected by intellectual property laws.

​

Custom deliverables:

Unless explicitly agreed in writing:

•Physical deliverables are sold to you, but underlying design files, tooling, templates, and methods remain ours.

•If we provide design files, the license (personal, commercial, transferable, etc.) will be stated in the SOW/quote. Otherwise, no rights are granted beyond what is necessary to use the delivered item.

 

Infringing requests: We may refuse orders that, in our judgment, involve infringement (e.g., copyrighted characters/logos without permission).

12) Product Use and Safety Disclaimers

 

(3D Printed/Fabricated Items)You are responsible for safe use and compliance with applicable laws and regulations.Unless explicitly stated in writing:•Items are not certified for medical, life-safety, or mission-critical use.•Items may have material and temperature limitations and may deform under heat, UV exposure, chemicals, load, or impact.•Some items may contain small parts and may present a choking hazard; keep away from children where applicable.•Items are not guaranteed food-safe unless explicitly labeled as such and accompanied by care instructions.PrintSmith3D is not responsible for damages or injuries resulting from misuse, improper installation, modification, or use outside intended conditions.

13) Prohibited Uses

 

You agree not to:

•Violate any law or regulation

•Attempt unauthorized access to the Site or systems•Introduce malware, scraping, or disruptive activity

•Use the Site for fraudulent, deceptive, or infringing purposes

We may suspend or terminate access for violations.

14) Third-Party Services

 

The Site may use third-party services (e.g., payment processors, shipping carriers, analytics). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms.

15) Disclaimers of Warranties

 

To the fullest extent permitted by law, the Site and products/services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.Some jurisdictions limit disclaimers; in such cases, disclaimers apply to the maximum extent permitted.

16) Limitation of Liability

 

To the fullest extent permitted by law, PrintSmith3D will not be liable for indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim will not exceed the amount you paid to PrintSmith3D for the order giving rise to the claim.

17) Indemnification

 

You agree to indemnify and hold harmless PrintSmith3D from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of products, or violation of any law or third-party rights.

18) Force Majeure

 

We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, supply shortages, labor disputes, severe weather, power outages, or governmental actions.

19) Governing Law and Venue (Wisconsin)

 

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

 

Any dispute arising out of or relating to these Terms, the Site, or any order shall be brought in the state or federal courts located in Outagamie, Wisconsin, and you consent to personal jurisdiction and venue in those courts.

20) Severability

 

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

21) Entire Agreement

 

These Terms, along with any referenced policies (including any Return Policy, Shipping Policy, and Privacy Policy posted on the Site) and any applicable SOW/quote, constitute the entire agreement between you and PrintSmith3D regarding your use of the Site and your purchases.
